The Delhi High Court has ordered that the elections of the Roller Skating Federation of India shall be conducted in terms of the National Sports Code and the constitution of the Indian Olympic Association.
Justice Mini Pushkarna was dealing with a plea filed by Gujarat State Roller Skating Association seeking that the election process initiated be declared null and void.
It was alleged that the Roller Skating Federation of India was resorting to all activities that were against the good governance in the sports of roller skating.
The plea alleged that the Federation was conducting its elections without complying with the provisions of its own constitution, constitution of National Sports Development Code of India, 2011 and the guidelines on the subject.
It was alleged by removing some official State Associations arbitrarily without any reason, the Federation have recognition to some other association arbitrarily, which never complied with the membership criteria.
The Union Government submitted that only the members of the State or Union Territory Association, duly affiliated, can be part of the Electoral College of the Federation.
“Noting the aforesaid submission made by the respondent no. 2 – Union of India, the Returning Officer is directed to ensure that any elections to be conducted and the Electoral College which is formed, shall be in terms of the various Guidelines issued in this regard, including, the National Sports Code, and the constitution of the Indian Olympic Association,” the Court said.
It further clarified that though the election process can proceed, the same shall be a subject to the outcome of the petition.
The Court issued notice in the plea and granted six weeks' time to the respondents to file the replies.
The matter will now be heard on September 16.
