Delhi High Court Issues Notice On AAP's Plea Against 'Ex Parte' Cancellation Of State Party Office Allotment

The Delhi High Court on Monday issued notice on a plea filed by Aam Aadmi Party (AAP) against alleged ex parte cancellation of allotment of its State Party Office in the national capital by the Directorate of Estates.
The party has also challenged imposing of rent at market rates for the occupation of the party office, stating that the same was done without intimating AAP about the alleged cancellation of allotment.
Justice Sachin Datta sought response of Union of India and the Directorate of Estates and listed the matter on August 12.
The Court also issued notice on AAP's application seeking stay of two bills imposing market rent for the occupation of the State Party Office, for the period between September 14, 2024, to April 29, 2025.
AAP has challenged the order issued by the Directorate of Estates on September 14 last year, allegedly cancelling the allotment in its favour for the premises.
“The fact and contents of the ex parte Order were belatedly conveyed to the Petitioner for the first time in a Letter dated 17.01.2025 addressed by the Respondent No. 2, calling upon the Petitioner to comply with the ex parte Order dated 14.09.2024, which has never been shared with the Petitioner, to this date,” the plea states.
It adds that the cancellation of allotment is in violation of the Office Memorandum issued as Compendium of the Allotment of Government Residence (General Pool in Delhi) Rules, 1963 and the GIST of the instructions issued by the Directorate of Estates.
“…/the ex parte Cancellation Order dated 14.09.2024 is non-est in the eyes of law as it was passed without issuing any show cause notice to the Petitioner, denying a reasonable opportunity to be heard, before cancelling the allotment of the State Party Office; accordingly, being violative of the principles of natural justice, the alleged Cancellation Order dated 14.09.2024 cannot be brought into effect,” the plea reads.
